jeCheck Terms of Service
Effective date: October 20, 2026
These Terms of Service (the "Terms") govern access to and use of the jeCheck cloud service: the web workspace at https://app.jecheck.io, the jeCheck mobile apps, the API and related websites, including https://jecheck.io (together, the "Service"). The Service is provided by the jeCheck team ("jeCheck", "we", "us", "our").
The website and the Service are operated by Individual Entrepreneur "DADENOVA" (Aknur Bakhytovna Dadenova, IIN 910812400209, 90/54 Kanysh Satpayev Street, Block 4, Almaly District, Almaty, Republic of Kazakhstan). Contact details are on the Legal notice page.
By registering an account, clicking to accept these Terms, paying for a plan or otherwise starting to use the Service, you confirm that you have read and accept these Terms. If you accept the Terms on behalf of a company, you confirm that you are authorized to do so, and "Customer", "you" and "your" refer to that company.
1. Definitions
1.1. Customer — a legal entity, sole trader or individual who has accepted these Terms and created a company account in the Service.
1.2. Company account — the Customer's workspace in the Service that holds the Customer's data, settings, locations and users.
1.3. User — an employee, contractor or other person to whom the Customer has given access to its company account (including via the mobile app).
1.4. Customer Data — any data that the Customer and its Users upload to or create in the Service: checklists, audit results, photos, videos, audio, tasks, instructions, work schedules, clock-ins, tests, reports and the like, including personal data of employees and other individuals.
1.5. Plan — a set of features, limits and a price published at https://jecheck.io/en/pricing or agreed with the Customer individually.
1.6. Location — a Customer site (restaurant, store, branch, etc.) set up in the Service; the number of locations is used to calculate the price of a paid Plan.
2. What we provide
2.1. jeCheck grants the Customer a non-exclusive, non-transferable, revocable right to access and use the Service for the Customer's internal business purposes for the term of these Terms and within the scope of the selected Plan.
2.2. The Service is provided as software as a service (SaaS): we host, maintain and update the Service, and the Customer accesses it over the internet. No rights to the source code are transferred to the Customer.
2.3. We continuously develop the Service and may add, change or remove features. If a change materially reduces the features of a paid Plan the Customer has already paid for, we will give advance notice, and the Customer may cancel the Plan and receive a pro-rata refund for the unused prepaid period.
2.4. Onboarding, training, custom configuration, custom development and done-for-you services (such as mystery shopper visits) are not included by default and are provided under a separate agreement.
3. Account and access
3.1. To use the Service you need to register a company account and provide accurate information. The person who creates the account receives administrator rights.
3.2. The Customer decides which Users get access and with what permissions, and is responsible for its Users' actions in the Service as if they were its own.
3.3. The Customer keeps logins, passwords and access tokens confidential and notifies us promptly at [email protected] of any suspected unauthorized access.
3.4. The Service is intended for business use. A company account may only be created by a person aged 18 or over.
4. Plans, payment and renewal
4.1. The Start plan is free with no time limit, within the published limits. Paid Plans and their prices are listed at https://jecheck.io/en/pricing; the price of a paid Plan is based on the number of locations.
4.2. Fees are paid in advance for the selected period (monthly or annual), online via the payment provider shown on the checkout page or by invoice. Card details are processed by the payment provider; jeCheck does not store them.
4.3. Subscriptions renew automatically for the same period until the Customer turns off auto-renewal in the billing section of the workspace or contacts us. Cancellation takes effect at the end of the current paid period.
4.4. Prices exclude taxes unless stated otherwise. Taxes, duties and bank fees applicable to the Customer are paid by the Customer.
4.5. We may change our prices. A new price applies from the next billing period; we will notify you at least 30 days in advance by email or in the workspace.
4.6. If the Customer adds locations or upgrades to a more expensive Plan mid-period, the additional charge is prorated for the remaining term.
4.7. Refunds. If the Service is not right for you, you can email [email protected] within 14 days of your first payment for a paid Plan and receive a full refund of that first payment. Otherwise, paid periods are non-refundable, except as expressly stated in these Terms or required by applicable law.
4.8. If payment is overdue, we may, after notice, move the account to the free Plan or restrict access to paid features. Customer Data is not deleted in that case within the periods set out in Section 12.
5. Acceptable use
5.1. The Customer and its Users must not:
- use the Service in breach of applicable law or the rights of third parties, including data protection and employment laws;
- upload unlawful, harmful or offensive content, or content that infringes the intellectual property rights of others;
- attempt to gain unauthorized access to the Service, other accounts or data, or circumvent technical restrictions and limits;
- decompile, reverse engineer or copy the Service, except where expressly permitted by law;
- resell, rent out or sublicense access to the Service, or use it to build a competing product, without our written consent;
- place an excessive load on the Service, including through automated requests beyond the API limits.
5.2. If Section 5 is breached, we may remove the relevant content or suspend access for a specific User or the entire account. Unless the situation requires immediate action, we will first notify the Customer and give a reasonable period to remedy the breach.
6. Customer Data and personal data
6.1. The Customer owns all rights to Customer Data. The Customer grants jeCheck the right to store, process and display Customer Data only to the extent necessary to provide the Service and support, ensure security and comply with the law.
6.2. With respect to personal data that the Customer and its Users enter into the Service (for example, employee data, schedules, clock-ins with geolocation, photos, videos and recordings from audits, test results), the Customer acts as the controller and jeCheck as the processor, acting on the Customer's behalf and on its documented instructions. Under these Terms:
- we process such data only to provide the Service and on the Customer's instructions as expressed in the Service settings and these Terms;
- persons with access to the data are bound by confidentiality;
- we apply the technical and organizational security measures described in the Privacy Policy;
- we engage sub-processors (hosting, file storage, email delivery, AI providers, etc.) on terms no less protective than these; the list is available on request, we give advance notice of material changes, and the Customer may object;
- we help the Customer respond to data subject requests and notify the Customer without undue delay of security incidents affecting its data;
- when the Customer stops using the Service, we delete or return the data in accordance with Section 12.
At the Customer's request we will sign a separate Data Processing Agreement (DPA); in case of conflict, the DPA prevails over this Section.
6.3. The Customer is responsible for having a lawful basis for processing the personal data of its employees and other individuals in the Service, for informing them and, where required, obtaining consent — including when using geolocation, the camera, photo and video capture and strict test mode.
6.4. Processing of personal data for which jeCheck itself determines the purposes (account registration, correspondence, payments, marketing emails, website visits) is described in the Privacy Policy.
6.5. Aggregated statistics. We may use aggregated and anonymized usage data that does not identify the Customer, a User or any other individual to improve the Service and for industry analytics and benchmarks. Customer checklists or other materials are made publicly available (for example, in the template library) only with the Customer's explicit consent.
7. AI features
7.1. Some features of the Service use artificial intelligence models from third-party providers (for example, for audit analysis, report generation, the AI assistant, and creating tests and checklists). For these features to work, the relevant parts of Customer Data are sent to the AI provider.
7.2. We use AI providers on terms under which the data sent is not used to train their models.
7.3. AI output is for assistance only and may contain inaccuracies. The Customer reviews it before use and makes its own decisions about employees, counterparties and business processes. The Service does not make decisions with legal effects on individuals on the Customer's behalf.
8. Intellectual property
8.1. The Service, its code, design, texts, templates, trademarks and other jeCheck materials belong to jeCheck or its licensors. These Terms grant the Customer no rights to them other than the right to use the Service expressly set out in Section 2.
8.2. If the Customer sends us ideas, feedback or suggestions for improving the Service, we may use them freely without any obligation to the Customer.
8.3. We may list the Customer's name and logo among jeCheck customers on our website and in presentations. The Customer may object at any time by emailing [email protected].
9. Support and availability
9.1. We provide support on using the Service via chat and the support section of the workspace, and at [email protected], on business days. Response times depend on the Plan; priority support is provided on Plans where it is listed.
9.2. We use commercially reasonable efforts to keep the Service available 24/7 but do not guarantee uninterrupted operation. Where possible, we schedule planned maintenance for low-traffic hours and announce it in advance.
9.3. We back up data regularly. The Customer can export its data at any time using the export tools available in the Service.
10. Warranties and limitation of liability
10.1. The Service is provided "as is" and "as available". To the extent permitted by applicable law, jeCheck gives no warranties other than those expressly stated in these Terms, including any warranty of fitness for a particular purpose.
10.2. The Service helps organize audits, standards and processes, but it does not replace professional advice and does not guarantee the Customer's compliance with sanitary, industry or other mandatory requirements. The Customer remains responsible for such compliance.
10.3. To the extent permitted by applicable law, jeCheck is not liable for lost profits, loss of revenue or goodwill, or for indirect, incidental or consequential damages.
10.4. jeCheck's total liability under these Terms is limited to the amount the Customer paid for the Service in the 12 months preceding the event giving rise to the claim. For the free Plan, liability is limited to USD 100.
10.5. The limitations in Section 10 do not apply to liability for intent or gross negligence, for death or personal injury, or in any other case where limitation of liability is prohibited by law. If the Customer is a consumer, they retain all rights that cannot be limited by contract under the law of their country of residence.
10.6. The Customer will indemnify jeCheck against losses and costs arising from third-party claims relating to Customer Data or the Customer's breach of Section 5 or Clause 6.3.
11. Force majeure
Neither party is liable for failure to perform its obligations caused by circumstances beyond its reasonable foresight and control, including natural disasters, armed conflict, acts of government, large-scale internet, power or third-party infrastructure outages, and DDoS attacks. The time for performance is extended for the duration of such circumstances.
12. Term, termination and data after termination
12.1. These Terms apply from acceptance until the company account is deleted.
12.2. The Customer may stop using the Service at any time by turning off auto-renewal and deleting the account, or by emailing [email protected]. The paid period is not refunded except as provided in Clauses 2.3 and 4.7.
12.3. jeCheck may terminate these Terms with at least 30 days' notice, or with immediate effect upon notice if the Customer materially breaches these Terms and fails to remedy the breach within a reasonable time after notice. If we terminate without fault on the Customer's part, we will refund the pro-rata portion of fees for the unused period.
12.4. Within 30 days after termination, the Customer may request an export of its data. After that, Customer Data is deleted from live systems, and from backups as they are rotated (within 90 days), except for data we are required by law to retain (for example, payment and accounting records).
12.5. Provisions that by their nature should survive termination (payment of outstanding amounts, intellectual property, limitation of liability, indemnity, governing law) remain in effect.
13. Changes to these Terms
13.1. We may update these Terms. The current version, with its effective date, is always published on this page.
13.2. We will notify you of material changes at least 30 days in advance by email or in the workspace. If the Customer does not agree with the new version, it may stop using the Service before the changes take effect and receive a pro-rata refund for the unused prepaid period. Continued use of the Service after the changes take effect constitutes acceptance.
14. Governing law and disputes
14.1. The parties will try to resolve any disagreement through negotiation. Claims can be sent to [email protected]; we will respond within 30 days.
14.2. If a dispute cannot be resolved through negotiation, it will be settled by the competent court at jeCheck's place of establishment under the law of that country, without regard to its conflict-of-law rules. A Customer who is a consumer may also bring proceedings in the courts of their place of residence and retains the protection of the mandatory laws of their country of residence.
15. Miscellaneous
15.1. These Terms, the Privacy Policy, the Pricing page and any documents signed by the parties (an order form, DPA or individual agreement) constitute the entire agreement between the parties. In case of conflict, a signed individual agreement prevails over these Terms.
15.2. The Customer may not assign its rights and obligations under these Terms without our consent. jeCheck may assign them to a successor in a reorganization or sale of the business, with notice to the Customer.
15.3. If any provision of these Terms is held invalid, the remaining provisions remain in force.
15.4. A party's failure to exercise a right is not a waiver of that right.
15.5. Notices are sent by email: to the Customer at the account administrator's address, and to us at [email protected]. The parties recognize the legal effect of email correspondence and in-workspace notices.
15.6. These Terms are drawn up in English and Russian. Translations into other languages are provided for convenience.
